Article 1 - Purpose
These Terms and Conditions (hereinafter referred to as "Terms and Conditions of Sale "or "Agreement " or “Terms and Conditions”) are intended, first, to inform any potential consumer on the terms and conditions under which the seller ("BIJOUXPRIVES") is conducting the sale and delivery of goods ordered by the Consumer(s) (The “Buyer(s)” or the “Purchaser(s)) and, secondly, to define the rights and obligations of the parties in connection with the sale of products by BIJOUXPRIVES to consumers ("Buyer ").
These Terms and Conditions (hereinafter referred to as "Terms and Conditions of Sale "or "Agreement " or “Terms and Conditions”) are intended, first, to inform any potential consumer on the terms and conditions under which the seller ("BIJOUXPRIVES") is conducting the sale and delivery of goods ordered by the Consumer(s) (The “Buyer(s)” or the “Purchaser(s)) and, secondly, to define the rights and obligations of the parties in connection with the sale of products by BIJOUXPRIVES to consumers ("Buyer ").
They apply without restriction or reservation, to all orders for delivery in metropolitan France, overseas territories and abroad passed through the online sales system of the website www.bijouxprives.com (hereinafter referred to as the “Website”) or by phone at 0800400250 (or +33800400250) through BIJOUXPRIVES Customer Service (hereinafter referred to as "Customer Service").
Consequently, any person who orders a product offered for sale on the Website or through the Customer Service accepts without any restriction these Terms and Conditions, which the Buyer acknowledges before his order. For this purpose, the Contract is available on the website as a "print " version.
The Buyer prior to his order, acknowledges and recognizes that he has full legal capacity under the provisions of Articles 1123 and following of the French Civil Code, allowing him to engage under this Agreement.
BIJOUXPRIVES reserves the right to modify at any time the hereby Terms and Conditions and the Terms of Use. Nevertheless, the General Sales Conditions applicable to the order placed by a Buyer on BIJOUXPRIVES Website or through the Customer Service are those accepted by the Buyer upon the execution of such an order.
These Terms and Conditions are additive to the Website Terms of Use, available at any time by clicking on "Terms of Use" and applicable to the Buyer and any Website visitor.
For purposes of this Agreement, The Buyer and BIJOUXPRIVES are individually or collectively, the Party or Parties.

Article 3 - Contract and Orders
3.1 Prices / Offers
The term of validity of offers and prices offered on the Website is their effective presence on the Website except in case of unavailability of any product.
Prices submitted by BIJOUXPRIVES are valid while products are on stock. For products not stocked in its warehouses, BIJOUXPRIVES may change prices at its sole discretion at any time according to variation in purchase prices, currencies or precious metal prices
BIJOUXPRIVES is likely to alter the mix of products offered for sale on its Website, according to particular constraints related to its suppliers, without prejudice to the orders placed by the Buyer.
Buyer may select one or several products among different categories offered on BIJOUXPRIVES.com Website.
The selling prices of products displayed on the Website are in Euros. If BIJOUXPRIVES decides to sell in any other currency, the currency will be clearly displayed on the Website. The prices are those displayed and in effect at the time of registration of the order by the Buyer.
During the checkout process (in the basket) the cost and handling and shipping will be clearly displayed and may differ according to shipping country, state and address.
3.1.1 Delivery in France:
Prices are quoted in Euros and include value added tax (VAT) on the day of the order. Any change in the applicable rate will be reflected in the price of products sold on BIJOUXPRIVES Website. The prices displayed on the items do not include specific discounts such as discount coupons from a sponsorship. To apply a valid discount coupon, the Buyer is required to enter a valid coupon code in the coupon area during the checkout process (in the basket) on the Website.
For delivery in France, the prices displayed include VAT, shipping and handling costs, order processing and packaging, and an individual box or bag for each acquisition.
The shipping and handling costs and any other costs for a delivery outside of mainland France and particularly to destinations in Andorra, Monaco, DOM-TOM, St. Martin, St. Barthelemy are, unless specific indication, at the Buyer’s expenses.
3.1.2 Deliveries outside France:
For orders shipped to another country than France, the Purchaser is the importer of the products ordered.
3.1.2.1 Delivery to one of the countries of the European Union:
Prices are quoted in Euros all taxes included (VAT) and include the Value Added Tax (VAT) of the country of destination, applicable on the date of the order. Any change in the applicable rate will be reflected in the price of products sold by BIJOUXPRIVES on its Website. The prices displayed on the items do not include specific discounts such as discount coupons from a sponsorship. To apply a valid discount coupon, the Buyer is required to enter a valid coupon code in the coupon area during the checkout process (in the basket) on the Website.
Prices for shipping and handling costs, if applicable, will be displayed during the checkout process on the Website.
The various delivery options with their corresponding costs are presented during the checkout process and specified in the order summary before validation.
Within the European Union, no customs duties are applicable. The buyer is the importer of the products. It is the responsibility of the Buyer to verify that the products imported into the country comply with the Laws, Acts and the Regulations of that country.
3.1.2.2 Deliveries outside the European Union:
For orders shipped outside the European Union, prices displayed are exclusive of taxes, shipping costs (unless specified) and local customs duties or specific taxes.
The Buyer is the importer of the imported goods and is responsible and liable for the compliance with the Laws, Acts and the Regulations of the importing country. Particularly, he is reponsible and has the duty to check constraints on imports of any product including precious jewels in his country (stamps and/or specific taxes).

BIJOUXPRIVES reserves the right to change prices at any time and without notice, subject to Article 1§6 of this Agreement.
3.2 Characteristics of products
Pursuant to Article L. 111-1 of the Consumer Code, the Purchaser may, prior to his order, read on the Website, the essential characteristics of the product(s) they want to order.
3.2.1 Products
All diamonds over 0.3 carat on sale on the Website are delivered with a diamond certificate issued by an independent gemological laboratory (such as the International Gemological Institute (IGI), Hoge Raad voor Diamant, or the Diamond High Council (HRD), the GIA (Gemological Institute of America), the Chamber of Commerce and Industry of Paris (CCIP) or any other recognized lab that describes their own characteristics and has a unique reference number. This certificate is in French or English.
BIJOUXPRIVES is a registered as a Jeweller in France and provides only authentic Jewellery from safe suppliers that comply with laws and regulations.
These products have the punches (stamps) and comply with French law.
Consequently, any person who orders a product offered for sale on the Website or through the Customer Service accepts without any restriction these Terms and Conditions, which the Buyer acknowledges before his order. For this purpose, the Contract is available on the website as a "print " version.
The Buyer prior to his order, acknowledges and recognizes that he has full legal capacity under the provisions of Articles 1123 and following of the French Civil Code, allowing him to engage under this Agreement.
BIJOUXPRIVES reserves the right to modify at any time the hereby Terms and Conditions and the Terms of Use. BIJOUXPRIVES reserves the right to change prices at any time and without notice, subject to Article 1§6 of this Agreement.
3.2 Characteristics of products

3.3 Order
Each order requires adherence to this Agreement, without prejudice to specific contractual terms entered into between the Parties.
3.3.1 Conditions
To order, the Buyer shall report to be at least 18 years old and have the legal capacity to make and fulfill orders or holds parental permission in order to proceed and fulfill the order and must be able to justify his situation at any time, upon request.
3.3.2 Procedures
The Buyer may place an order:
- Directly on the Website,
- By phone through the Customer Service, Tel: 800 400 250 (toll free from mainland France) or +33 800 400 250 from any country outside France from Monday to Friday from 10AM to 6M (French time) except during French bank holidays.
BIJOUXPRIVES will acknowledge the receipt of the order if the following steps are followed:
Step 1: Buyer validates the "basket "and the proposed mode of delivery (with price) during the checkout process
Step 2: Buyers identify themselves on their first visit to the Website and create their account in the " My Account " area by entering all the data requested, namely:
- name, surname
- contact information (phone and email)
- specific billing Address
- specific delivery address (PO boxes are not accepted)
- and validate information .
If the Buyer has already created an account in the " My Account " area on the Website, they go directly to the third step.
Step 3: Buyer,
- validates the shipping address, the chosen billing and delivery method with its cost
- clicks the box confirming that Buyer has read and agrees with the BIJOUXPRIVES Sales Terms and Conditions,
- clicks on "proceed to payment ".
Step 4: Buyer:
- reviews the details of his order, the total price including VAT for European Union deliveries and without VAT for countries outside European Union, shipping and billing address and chosen shipping carrier and method,
- chooses the payment method
- shall make payment by clicking on "proceed with your order”, then clicks the
secure payment page by clicking on " Submit "
3.3.3 Acknowledgment of the Order
Upon registration of the order (by phone or on the website) and within a maximum of 3 (three) business days after registration, BIJOUXPRIVES acknowledges receipt of the order placed and informs the Buyer by email. BIJOUXPRIVES is bound by the order to the confirmation of this acknowledgment. BIJOUXPRIVES reserves the right to refuse, without any liability to the Buyer, any order placed by the Buyer, for any reason, including but not limited to the case where there may be any doubt or dispute over the payment of a previous order, or for a unreferenced delivery address (hotels or PO boxes), or for any doubt on the validity of the order ...
BIJOUXPRIVES recommends that Buyer retain the information contained in the order confirmation sent by BIJOUXPRIVES on a printed paper or within his computer.
The sale will be considered “executed” (I) after the provision of the order confirmation to the BIJOUXPRIVES Buyer and (ii) reception by BIJOUXPRIVES of the full price of the order (see section 4 below).
3.3.4 Changes in case of unavailability of the ordered product
The products and their prices mentioned on the Website are valid in the limit of available stocks.
BIJOUXPRIVES reserves the right to modify the content of the order placed by the Purchaser in the event that the ordered products are unavailable.
Should it happen that some of the products ordered by the Buyer are no longer available, BIJOUXPRIVES undertakes to substitute products of equivalent quality and price in the limit of available stocks, without changing the price of the order to the Buyer. BIJOUXPRIVES informs the Buyer as soon as they become aware of such unavailability, and notifies the Buyer of the proposed substitution with precision of the new deadline. Buyer has the option either (i) to accept the proposed new product, or (ii) to get a full refund of the product ordered and duly paid within 30 (thirty) days after his request.
BIJOUXPRIVES also reserves the right to cancel all or part of an order in case of failure of one of its suppliers as well as in case of Force Majeure. BIJOUXPRIVES will notify the Buyer as soon as they become aware and will refund any amount that has already been paid by the Buyer in connection with the order or part of the order and collected by BIJOUXPRIVES.
Article 4 - Payment
Payment must be made when ordering online at the end of the checkout process or over the phone with BIJOUXPRIVES Customer Service. BIJOUXPRIVES accepts only full payment of the order and will not accept any partial payment or down payment. In case of down payment or partial payment, BIJOUXPRIVES may refuse the order and will not be liable to the Buyer.
Unless specified, all orders are payable in Euros. Any bank charges (such as exchange fees) are charged to the Buyer (including in the case of a refund).
To set the order on the Website or over the phone, the Buyer has the following payment methods:
- Credit card (Carte Bleue, Visa, Mastercard, American Express)
- Checks (only accepted by BIJOUXPRIVES if the checks are issued by a bank or financial institution authorized to practice in France)
- direct debit
- Wire Transfer
- PAYPAL account (Paypal affords also various other payment methods)
- Gift Certificates from BIJOUXPRIVES
- voucher sponsorship from BIJOUXPRIVES
To ensure the security of credit card payment, Buyer shall transmit to BIJOUXPRIVES the security code (CVV) on the back of the card used by the Purchaser and the necessary data required for a payment process according to 3D Secure protocol issued by 3D Secure registered banks.
BIJOUXPRIVES uses a secure payment tool, called "ATOS System”. Payment security is based on the authentication of the Purchaser, and the confidentiality of all data. To secure it, ATOS System uses proven cryptography techniques and respects the different banking regulations applicable in France.
For security reasons, BIJOUXPRIVES requires that the billing address registered during the checkout process shall be the same as the registered address on the credit card or on the check from the Buyer, in order to protect the Buyer from a possible misuse or fraud tentative.
3.3 Order
Each order requires adherence to this Agreement, without prejudice to specific contractual terms entered into between the Parties.

- clicks on "proceed to payment ".
Step 4: Buyer:
- reviews the details of his order, the total price including VAT for European Union deliveries and without VAT for countries outside European Union, shipping and billing address and chosen shipping carrier and method,
- chooses the payment method
- shall make payment by clicking on "proceed with your order”, then clicks the
secure payment page by clicking on " Submit "
3.3.3 Acknowledgment of the Order
Upon registration of the order (by phone or on the website) and within a maximum of 3 (three) business days after registration, BIJOUXPRIVES acknowledges receipt of the order placed and informs the Buyer by email. BIJOUXPRIVES is bound by the order to the confirmation of this acknowledgment. The Buyer 's bank account will be debited within around 48 (forty eight) hours after the order date and the order will be considered effective upon confirmation of the payment agreement by the payment centers to BIJOUXPRIVES.
Checks, issued only by registered banks in France, shall be made payable to BIJOUXPRIVES Paris SAS, and sent, with details of the order, to BIJOUXPRIVES SAS, 10 Rue Saint Augustin, 75002 Paris (France). The check deposit and control is performed upon receipt.
If payment is done by check, the order will be processed only after receipt confirmation of payment. The order will be cleared for expedition as soon as the payment deposit is received by BIJOUXPRIVES’ bank.
When paying by direct debit, a facsimile “direct debit” payment is available for printing on the website under "Support - Order Status -Payment by direct debit”.
BIJOUXPRIVES offers to its customers financing solutions for their purchase on the Website: By clicking on the link "financing", the buyer accesses the financing offers.
Under no circumstances BIJOUXPRIVES shall be liable or held to be responsible for obtaining or for failure to obtain and use credit or financing.

Article 5 - Delivery and reception

In case of failure to comply with contractual conditions described below, no claim from the Purchaser shall be accepted by BIJOUXPRIVES, and BIJOUXPRIVES shall not be liable against the Purchaser or any of its representatives.
5.1.2 Characteristics of delivery
The product can be sent either by post (Service Declared Value of the Post Office) or by a private carrier, as provided in the order (Section 3.3.2).
Buyer is informed by BIJOUXPRIVES by email of the departure date of the products shipped.
The package is shipped to the Buyer; the carrier will require the Buyer to sign a delivery. The package can be delivered to another person, including any person connected to the Buyer, living with them. In that case, this person will sign the receipt on behalf of the Buyer that accepts it without any restriction, unless specified.
In case that the carrier has been unable to deliver the package (nobody at the shipping address etc), the Purchaser or recipient of the order will receive a notice of passage in their mailbox, allowing them to ask for a new delivery if the carrier agrees or in order to pick up the parcel at a Post Office or at the local Carrier office within 10 (ten) days of the filing of this notice. The Buyer may also take an appointment with the carrier in order to reschedule a delivery within a period of ten (10) days.
After this date, the package will returned to BIJOUXPRIVES. The Customer Service will contact the Buyer for a possible new shipment.
No dispute on the delivery itself is possible if the package appears to have been delivered by a registered Post office or Carrier.
In the presence of an apparent anomaly of the parcel (including damaged parcels, open packages, traces of liquid, etc.), the Purchaser or the consignee of the ordered goods must not open the package but is invited to report to BIJOUXPRIVES by calling BIJOUXPRIVES Customer Service at 0800 400 250 (toll free from France) or at +33800400250 from any country outside France From 10AM to 6PM (French time) from Monday to Friday, stating the name, the date and the order number
Checks, issued only by registered banks in France, shall be made payable to BIJOUXPRIVES Paris SAS, and sent, with details of the order, to BIJOUXPRIVES SAS, 10 Rue Saint Augustin, 75002 Paris (France). The check deposit and control is performed upon receipt.
If payment is done by check, the order will be processed only after receipt confirmation of payment. The order will be cleared for expedition as soon as the payment deposit is received by BIJOUXPRIVES’ bank.
When paying by direct debit, a facsimile “direct debit” payment is available for printing on the website under "Support - Order Status -Payment by direct debit”.
BIJOUXPRIVES offers to its customers financing solutions for their purchase on the Website: By clicking on the link "financing", the buyer accesses the financing offers.

In case of opening of the parcel by the Buyer, no complaint against the Carrier shall be possible.

5.1.3 Delivery
The Purchaser has the possibility of tracking their order on the website or by calling BIJOUXPRIVES’ Customer Service. They will also receive information emails from BIJOUXPRIVES.
Unless otherwise specified, the product expedition is done within a maximum of 5 (five) weeks after payment validation of the order described above in the Section 3.2. For example, the expedition time can be reduced to 1 (one) week after the validation of the order when the product is on stock during the processing of the order.
Unless otherwise specified to the Buyer before placing the order and prior to any final confirmation thereof, for delivery to overseas territories or abroad, the expedition period is a maximum of 5 (five) weeks from validation of payment of the order described above in the Section 3.2.3, given the time of delivery. The Purchaser is invited, before ordering, to check all the necessary information with BIJOUXPRIVES Customer Service by contacting BIJOUXPRIVES at contact@bijouxprives.com or by calling 0800 400 250 (from France) and + 33 800 400 250 from any country outside France, from Monday to Friday from 10AM to 6PM (French time) excluding public French bank holidays.
Delivery will be deemed to occur at the time of first presentation of products to the delivery address indicated by the Buyer.
5.1.4 Delivery / lead time / delayed shipments
BIJOUXPRIVES will inform the Buyer in case of delayed shipment of the order.

The sales contract will be considered broken at the reception by BIJOUXPRIVES of the letter by which the Purchaser shall notify its decision if the delivery is not duly performed and has not been executed between the sending and receipt of this letter. The Purchaser shall exercise this right within 60 (sixty) days from the date specified for the delivery.
The total amount paid by the Buyer will be refunded if the entire order is returned in the form of a reimbursement or in a redeemable form at the option of the Purchaser, as soon as possible and no later than within 30 (thirty) days from the date on which the Purchaser has exercised its right to obtain cancellation of his order.

Article 6 – Cancelation and Refund clause (hereinafter “Cancelation and Refund”)
6.1 In accordance with Articles L. 121-20 and following of the French Consumer Code, the Purchaser shall have 7 (seven) days from the date of receipt of the order by themselves or by whom the order has been placed, to cancel their order and to ask for a return of the goods at their own expenses and only after having called BIJOUXPRIVES Customer Service for requesting a Return Merchandise Number (hereinafter “RMA” or “RMA #”). No return shall be accepted unless a RMA has been issued by BIJOUXPRIVES. The Buyer shall not send the goods directly. BIJOUXPRIVES carrier will pick up the goods at the Buyer address. After reception and control of the returned goods, the Purchaser may ask for the exchange of goods, or a credit or refund for the amount of the order.
The products must be returned to BIJOUXPRIVES following the procedure laid down under " Help - My Orders Return - products" available on the website and described in Article 8 - below. No product may be returned without asking for a BIJOUXPRIVES RMA#.
All the jewels come with a label. This label is called a “Label Seal”, it is attached to every jewel. This Label Seal shall not be withdrawn if the Buyer wishes to return the jewel to BIJOUXPRIVES and benefit from the option exercise of cancelation and refund (hereinafter “Refund” clause). Removing the label implies the buyer withdraw of all reserves and the decision to accept definitely the jewel renouncing definitely to the benefit of the Refund clause.
BIJOUXPRIVES will reimburse the Buyer within thirty (30) days following the date of receipt of returned goods following the date on which the Cancellation and Refund clause has been exercised. The refund of returned products will be done in compliance "with the terms of refund and Exchange" as defined in Article 9 below.
If the Buyer has decided to ask for a partial request of order cancelation (for specific items only), only the price charged for the goods returned will be refunded.
Products allowed for return or exchange shall only be products returned in their complete original packaging, with their accessories, manuals, case, certificate of authenticity, and in perfect condition, unused, undamaged, unworn, and with their Label seal.
6.2 No right of Cancelation and refund:
The right of Cancelation and/or Refund can not be exercised for the contracts listed in Article L.121 - 20-2 of the French Code of consumption. The right of Cancelation and/or Refund can not be exercised for order and contrats for:
- the supply of goods made according to the Buyer's specifications or specifically personalized or which, because of their nature, can not be returned.
- Pieces of jewellery that were engraved and personalized to a specific request (i.e printed name or message on a ring), specific finger size for a ring, specific manufacturing (hereinafter "specific manufacturing") (*1)
(*1) It is understood that when a product ordered by a customer is not available on stock, BIJOUXPRIVES will consequently order this product and ask for a "specific manufacturing" to the Manufacturer or Designer. Any product displayed on BIJOUXPRIVES website with a delivery time equal or greater than 15 days will require a "specific manufacturing" and thus is EXCLUDED from the benefit of the above "Cancelation or refund" clause.
- supply of jewellery that have not been returned in their original packaging with their accessory(s) and documentation(s) (user manuals, warranty certificate, case, certificate of authenticity, invoice, return request carefully filled and any other specific accessories) or that have been used, worn or damaged.
- In providing products which, because of their nature, cannot be returned.
- Withdrawal of Label Seal upon receipt of the jewel.
Article 7 - Product Compliance
7.1. The information listed on each product sheet describes the product that BIJOUXPRIVES displays for sale.
BIJOUXPRIVES will make its best efforts to take pictures of all the products on the website to describe them as well as possible. However, given the format of digital pictures, products or services on the Internet, it is possible that the Buyer consider that the photography of the product does not correspond exactly to the product itself.
7.2. In case that the Buyer considers there is a non-conformity of the product or service delivered, the buyer may ask for a Cancelation and Refund of his order to BIJOUXPRIVES. In that case, the Buyer must comply with the RMA procedure described in Article 8 - below.
The Buyer may request to BIJOUXPRIVES:
* to receive a product identical to the one ordered, within the limits of available stocks (eg different size);
* Or to exchange with a product having a quality and price equivalent to the product ordered in the limit of available stocks (in case of price difference, BIJOUXPRIVES will invoice or refund the Buyer)
* be refunded of the price of the product ordered within 30 days of its request for reimbursement and after due reception by BIJOUXPRIVES of the returned products
The cost of returning the product ordered and delivered to the Purchaser, and the eventual delivery of another product will be at BIJOUXPRIVES’ expenses.
7.3. In any event, the Buyer can always ask for the benefit of the Cancelation and Refund clause, as stated in the Article 6 of these Terms and Conditions of Sale.

Products returned to BIJOUXPRIVES must be in perfect condition for resale in their original packaging, box and conditions with all accessories (Original Certificate of Authenticity provided if any, packaging, accessories, manuals, including gift box, jewel case...), duly sealed and accompanied by the RMA signed by the Buyer, available on request from BIJOUXPRIVES Customer Service and accompanied by a copy of the original purchase invoice.
The failure to return the certificate of authenticity and warranty provided by BIJOUXPRIVES, will be charged to the Buyer 300 (three hundred) Euros excl. tax or 358.80 (three hundred fifty-eight Euros and eighty cents with tax). This amount will be deducted from the refunded amount.
Goods that will not be returned complete with their accessories, damaged or soiled, will under no circumstances be accepted nor refunded.
In addition, products that were, at the request of the Purchaser, personalized or with specific customization (including a frame that may have been engraved or any laser inscription on diamond(s), etc, will not be refunded or exchanged.
If the buyer returns the product for a size issue or for an exchange request, return costs will be at the Buyer expenses and new shipping costs will be at BIJOUXPRIVES’ expenses; if the buyer already had undertaken the benefit of the exchange or change of size provision, the Purchaser may no longer benefit from the provisions of Article 6 above.
Specialists and experts appointed for this purpose by BIJOUXPRIVES confirm that the material and stone, or any other component of the product correspond to what was originally sent, without damage, modification or intervention of any kind.
BIJOUXPRIVES accept the Cancelation or Refund request by mail or by any means, provided that this request is sent to BIJOUXPRIVES within 7 (seven) days from the date of receipt of the order by the Buyer.
The conformity of the returned goods and packaging remain the responsibility of the Buyer, except in cases of lack of conformity of products delivered under the conditions Article L.211 - 4 and following of the French Consumer Code.
The initial shipping costs are not reimbursed to the Purchaser except in the cases referred in above Article 5.1.4 relating to delivery times or Article 6 – above, relating to the exercise of right of withdrawal, or in case of lack of conformity of products delivered over the command within the meaning of Article L.211 -4 and following of the Code of consumption.
In case of an exchange of product(s), the costs associated to the new product delivery are the responsibility of the Buyer.
8.2 Arrangements for return of a product
To return a product, Purchaser must follow these instructions:
1. Call Customer Service at +33800 400 250 indicating that this is a request for return or exchange.
- The Customer Service will send by email the address of return, the number of the return coupon ( No "RMA ") if it has not already been provided and the procedure to follow in case of specific procedure.
- BIJOUXPRIVES will set up the return of the product.
- Otherwise, and assuming that the customer took the initiative to return the jewel by their own means or without asking for a return number to BIJOUXPRIVES, it is recalled that the return will be made at the risk of the Customer. Risk transfer will be effective upon receipt of the Product(s) by BIJOUXPRIVES verification of their condition, and subject to necessary expertise.
For security reasons, BIJOUXPRIVES storage sites are not at its headquarters. For this reason, BIJOUXPRIVES only receives its service center as jewellery sales have been sold by our company and with a return number. Otherwise, BIJOUXPRIVES will not be able to accept the receipt of those pieces of jewellery.
2. Use the original packaging to return the product(s).
3. Complete and attach the return form to detach from the Delivery form, a copy of the invoice, certificate of authenticity and/or the diamond certificate if they were sent with the product, the box and all accessories shipped with the product. Returns will not be accepted if sent without the Return form.
4. BIJOUXPRIVES will take care of the removal of the piece of jewellery from the client, through its specialized carrier.
In any case the package must be returned only after having notified the BIJOUXPRIVES Customer Service.
BIJOUXPRIVES does not accept parcels sent with no return number. Any risk associated with returning the product is at the Purchaser’s expenses. The buyer is responsible for transportation insurance when returning products not supported by BIJOUXPRIVES.
Article 9 - Arrangements for the refund and exchange
Any refund will be made at the discretion of BIJOUXPRIVES or by crediting the credit card or by bank transfer to the bank account of the Purchaser, or by sending a check to the customer who placed the order and to the billing address mentioned during the order.
However, subject to the agreement of the Purchaser, BIJOUXPRIVES may offer another means of payment.
In case of exchange, if the new order is of a greater amount than the original order, the Buyer will to send the payment along with the exchange request. Conversely, if the amount of the new order is less than the amount of the original order, the Purchaser will receive a refund of the overpayment following the same process mentioned above.
Gift certificates, vouchers or online discount purchases are not considered having any monetary values, therefore, they will not be refunded or exchanged.
The failure to return the certificate of authenticity and warranty provided by BIJOUXPRIVES, will be charged to the Buyer 300 (three hundred) Euros excl. tax or 358.80 (three hundred fifty-eight Euros and eighty cents with tax). This amount will be deducted from the refunded amount.
Goods that will not be returned complete with their accessories, damaged or soiled, will under no circumstances be accepted nor refunded.
In addition, products that were, at the request of the Purchaser, personalized or with specific customization (including a frame that may have been engraved or any laser inscription on diamond(s), etc, will not be refunded or exchanged.
If the buyer returns the product for a size issue or for an exchange request, return costs will be at the Buyer expenses and new shipping costs will be at BIJOUXPRIVES’ expenses; if the buyer already had undertaken the benefit of the exchange or change of size provision, the Purchaser may no longer benefit from the provisions of Article 6 above.
Specialists and experts appointed for this purpose by BIJOUXPRIVES confirm that the material and stone, or any other component of the product correspond to what was originally sent, without damage, modification or intervention of any kind.

Article 10 - Guarantees
10.1 Guarantee Contract
BIJOUXPRIVES guarantees that the diamond(s) set on the product(s) that you will receive are consistent with the certificate(s) of diamond that will come with it.
Furthermore, the goods purchased on the Website are protected under normal use against their defects for a period of one (1) year from the delivery (parts and labor). BIJOUXPRIVES undertakes the repairs or the exchange the apparently defective products that they would return during this period, as described in Articles 8 and 9.
This guarantee will only be granted to the Buyer if:
( i) All conditions described in Section 8.1 are met;
( ii ) The failure of the product is not due to :
- abnormal or non-conforming use of the product;
- wear and tear or normal aging ;
- An accidental event or, more generally , an external cause ( such as the intervention of any unauthorized third party on the product) .
Shipping costs and returns of products are at the Buyer’s expenses.
Excluded from warranty are the products or services that are modified, repaired, built or added by the Purchaser or any other person not authorized by the supplier of the product or service. The warranty will not be applicable for the defects. The guarantee does not support the products or services damaged during shipping or misuse.
10.2 Statutory warranties
Regardless of the security referred to in Article 9.1, BIJOUXPRIVES remain liable for defects in product compliance with the Contract and latent defects in the conditions provided in sections 1641 to 1649 Civil Code:
Article L. 211-4 of the Consumer Code: " The seller must deliver goods in conformity with the contract and is responsible for the lack of conformity at the issue. He is also responsible for the lack of conformity resulting from the packaging, instructions for assembly or installation when it was put to him by the contract or when carried out under his responsibility. "
Article L. 211-5 of the Consumer Code: " To comply with the contract, the goods must:
1 Be used in usual and conventional ways for such a good and where applicable:
- Match the description given by the seller and possess the qualities that he has submitted to the buyer in a sample or model;
- have the qualities that a buyer might reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;
2 Or have the characteristics defined, by mutual agreement, by the parties or be suitable for any particular purpose for which the buyer made known to the seller and that he accepted. "
Article L. 211-12 of the Consumer code: " Legal action based on lack of conformity within two years from delivery of the goods. "
Article 1641 Civil Code: "The seller is obliged to guarantee to latent defects of the product sold which render it unfit for the use for which it was intended, or that decrease this use which means that the buyer would not have acquired it, or would have paid a lower price if they had known. "
First paragraph of Article 1648 Civil Code: "Any action resulting from latent defects must be brought by the purchaser, within two years from the discovery of vice. "
10.3 Legal Guarantees
Without prejudice to the guarantees listed above, BIJOUXPRIVES makes no warranty on the Website and/or Content (as described in Article 12 below). In particular, BIJOUXPRIVES makes no warranty as to the suitability of any elements of the Website for any particular purpose. BIJOUXPRIVES does not guarantee that the functions contained on the Website as well as any content or other material contained therein shall at all times be available, uninterrupted or error free, that defects or errors are possible immediately corrected, or that the Website or its server will be to any time free of viruses or other components likely to cause injury.
Article 11 - Retention of title
BIJOUXPRIVES retains full ownership of the goods sold until full payment is received, principal, fees, taxes and mandatory contributions included.
Article 12 - Liability
BIJOUXPRIVES cannot be held liable for any damages that may arise from the purchase of products. Similarly, regarding the obligations mentioned in these Terms of Use, BIJOUXPRIVES shall not be liable for any occurrence of an event of force majeure as defined by the French courts, and especially in case of fire, flood, interruption of the supply of energy, raw materials and the total or partial strikes of any kind affecting the proper functioning of a company, such as transportation strikes, postal services.
12.1 The products comply with the French legislation then in force. BIJOUXPRIVES cannot be held liable for non-compliance of the country’s legislation where the goods are delivered. It belongs to the Buyer to check with local authorities the possibilities and conditions for importing products whose order is being considered, and respected the sole responsibility of Buyer.
12.2 The product images are presented for illustrative purposes only. Consequently, BIJOUXPRIVES cannot be held liable for differences between product photos and product delivered. BIJOUXPRIVES invites the Buyer to refer to the description of each product to know the precise characteristics. In case of doubt or if they want additional information, the Buyer must contact the customer service.
12.3 Unless fraud or gross negligence and except in cases of liability for defective products, the total liability of BIJOUXPRIVES, for all injuries compensable under the Contract terms, is limited to only repairing damage foreseeable direct and material actually suffered by the Buyer due to the failure of BIJOUXPRIVES. Such compensation shall in no case exceed the amount of the buyer’s latest purchase, and even if BIJOUXPRIVES has been advised of the possibility of such damages.
It is clear that under the Contract, what is deemed to be collateral damage is not eligible for compensation by BIJOUXPRIVES, even though they could be expected, loss of profits, revenue, data, databases or programs, the loss of savings and all additional costs and damages of every image and all third party claims.
BIJOUXPRIVES will not be responsible in particular with regard to the damage caused by Buyer (I) their own act, omission or malpractice; (II) any event of force majeure as defined by case law made by the French courts (III) any third party unrelated to BIJOUXPRIVES for the execution of the contract (for example, where performance problems resulting from congestion or connection means or telecommunications services or equipment performance computing) or (IV) any other event that neither BIJOUXPRIVES, nor its suppliers could have foreseen or prevented even if BIJOUXPRIVES or its suppliers had taken all reasonable precautions.
In particular, will be considered under the Buyer's own act, omission or fault: damage and loss due to the inadequacy or incompatibility of their computer equipment (hardware and/or software) to all or part of the Website and/or lack of implementation of all necessary and reasonable safeguards against any programs, or communications devices damaging because it belongs to the Purchaser, and them alone (I) to test or check that their computer equipment and/or telecommunications is suitable and compatible with the Website, prior to use and (II ) to develop and implement all reasonable and necessary protections against any programs, or communications devices damaging, particularly using anti-virus software.
12.4 The Website may contain links to other sites on the Internet. These other sites are not under the control of BIJOUXPRIVES and Buyer acknowledges that BIJOUXPRIVES is not responsible for the accuracy, respect for intellectual property rights, legality, decency or any other aspect of the content of these websites. The inclusion of such links does not imply any endorsement of BIJOUXPRIVES or any association with its operators. BIJOUXPRIVES cannot guarantee that the Purchaser will be satisfied with any product or service provided on another website that was a hyperlink from or to the Website, considering that other online businesses are owned by traders and are operated by them. BIJOUXPRIVES does not promote any goods and has not tried to confirm the accuracy or reliability of any information contained on these sites. BIJOUXPRIVES urges the Buyer to conduct any research they consider necessary or appropriate before making any electronic transaction whatsoever with any of these third parties.
12.5 Without prejudice to the provisions of Articles L. 211-12 of the Consumer Code and 1648 of the Civil Code (recalled in Section 10.2 above) and other mandatory legal provisions, Buyer agrees that any claim or action to arise from or related to the use of all the Website or the Contract (partially or in its entirety), shall be formulated and implemented judicially within one (1) year after one of the two following dates, (otherwise this won’t be possible): the date on which the claim has been made for the first time or the date on which the cause of the claim appeared for the first time.
Article 13 – Partial invalidity
If any provision of this Agreement is declared illegal, void or unenforceable for any reason whatsoever and it is not possible to substitute a right of reasonable provision with similar effect (an operation that the parties can now and already carry out at every court hearing, in the cases when it is permitted by applicable law), that provision will be deemed to be severable from the Agreement and shall not affect the validity and enforceability of the remaining provisions to the extent possible under the applicable law.
Article 14 – No Waiver
The failure of either Party not to take advantage of the other Party of any breach of the obligations referred to in these terms and conditions of sale cannot be interpreted a waiver of the obligation in question.
Article 15 – Miscellaneous
15.1BIJOUXPRIVES is free to transfer (by any means and in any form whatsoever, including by merger) its rights and obligations under the Agreement without noticing it to the Purchaser: (i) any entity that is or be related or (ii) any person or entity that will control directly or indirectly from any or a significant portion of its assets or its capital or voting rights or those of related entities. The Purchaser may not transfer (by any means) the Agreement, without the prior written consent of BIJOUXPRIVES.
15.2 BIJOUXPRIVES may send to the Purchaser any notification under the Contract, whether in the form of a publication on the Website or by email or by regular mail, express or registered mail to the address that BIJOUXPRIVES has in its systems. The Purchaser acknowledges and accepts that one or other of these forms of notifications, selected by BIJOUXPRIVES is sufficient for their information.
15.3 BIJOUXPRIVES may rely, particularly for evidence of any act done or omitted regarding programs, data, files, records, operations and other elements (such as monitoring reports) in the nature or format or computer or electronic established, received or retained directly or indirectly by it, unless abuse or manifest error. Buyer agrees not to contest the admissibility or validity of the elements of nature or format or computer or electronic mentioned above.
15.4 The Website is subject to a security system: the method adopted is SSL encryption.

For orders placed by phone through customer service or online on the Website by any new customers, and in the event that the customer's consent specifically, this database will be enriched by means of personal information provided to better meet their expectations and facilitate access to the assistance benefits provided by the Customer Service.
This database has been declared to the CNIL (IT and Freedoms committee), in accordance with the requirements prescribed by the law "IT and Freedoms" n ° 78-17 of January 6, 1978, as amended by the Law 2004-801 of 6 August 2004.

Depending on the choices made when creating or consulting their accounts on the Internet, the Customer can choose whether to receive the BIJOUXPRIVES newsletter, commercial offers or be informed of specific transactions via email. If a client no longer wishes to receive offers, they may at any time make that request by clicking a link available on the emails or uncheck the "receive newsletter " box in their account on the site www.bijouxprives.com.
BIJOUXPRIVES pays special attention to the needs of its customers. For this reason, it makes use of cookies. The cookie's purpose is to show the passage of the client on the website. Cookies are used by BIJOUXPRIVES in order to improve the personal service offered to the customer.
Article 17 – Convention on the evidence
In accordance with the Article 1369-2 of the Civil Code, it is expressly agreed between the Parties that they (the buyer and BIJOUXPRIVES), can communicate with each other electronically or by telephone through customer service, for the purposes of these terms and conditions and as part of their business relationship.
Technical security measures are in place to ensure confidentiality of data exchanged.
The parties agree that emails exchanged between them validly prove the contents of their trade and, where applicable, their commitments, particularly regarding the transmission and acceptance of orders and returns management.

Article 18 – Applicable law and jurisdiction
These Terms and Conditions shall be interpreted and enforced in accordance with the French law. In case of dispute, the Purchaser should first contact BIJOUXPRIVES for an amicable solution. Otherwise, the French courts will have jurisdiction.
